  • When spouses separate, assets and debts must be divided between them. The legal starting point is that values should be split equally, but there are many exceptions to this, including unequal division and separate property.

  • It is not possible to fully protect yourself in advance, but a prenuptial agreement can provide greater predictability.

  • For example, by agreeing on good solutions in a prenuptial agreement, will, and cohabitation agreement.

  • A key question that arises in a divorce settlement is what should happen to individual assets, ranging from homes and cabins to shares and other securities.

    The question of how assets are divided is different from how the value of the assets is divided. The main rule is that each spouse can keep their own assets. Jointly owned assets must be sold if the spouses cannot agree on an alternative solution.

  • It is important not to sign documents related to the division of assets before clarifying your rights.

    A common mistake is that spouses agree on solutions in a prenuptial agreement that are invalid, typically that one spouse will take over the shared home.

    There are many misconceptions about what rights one has. For example, many people believe that joint property means owning something together, but that is incorrect.

  • Each year, we encounter many divisions of joint property and divorce settlements where the prenuptial agreement entered into by the parties is in violation of the mandatory rules of the Marriage Act.

    Spouses can enter into prenuptial agreements permitted under the Marriage Act, such as stipulating that assets will not be divided (separate property). However, spouses do not have complete contractual freedom in a prenuptial agreement.
